Linda Rzesniowiecki

In representing both landlords and tenants, Linda Rzesniowiecki has amassed considerable experience on both sides of the table. Her expertise enriches and adds depth to her understanding of the “big picture” of landlord and tenant law, and her track record of successful cases demonstrates her willingness to negotiate as well as litigate in appropriate circumstances.

  • Linda has been recognized as an authority on Loft Law in the State of New York, having written Chapter 18 on “Lofts and SROs” in Finkelstein and Ferrara’s Landlord and Tenant Practice in New York (1997) and co-authored an article entitled “The New York Loft Law” 38 N.Y Real Prop. L.J. 21 (Spring 2010).
  • Linda has lectured for the New York County Lawyer’s Association, the Queens County Women’s Bar Association and LeGal on subjects such as succession rights, loft law, rent overcharge, due diligence in buying multi-family residential property and holdover proceedings against profiteering tenants.
  • Linda has argued before the Court of Appeals, the Appellate Division, First Department, the Appellate Term, First Department, and the Appellate Term, Second Department.

Linda’s approach:

  1. a fine-tooled ability to help clients get past the legal jargon that may leave them confused or unable to proceed
  2. acute analysis in human terms of the client’s needs, by:
    • using her own firsthand observations of both the individuals and the physical spaces involved
    • working in collaboration with other lawyers who are also working for the same client (i.e., real estate lawyers or trusts and estates attorneys)
    • backing up her clients with an extensive network of related professionals — from private investigators1 to professional organizers2—whose talents help realize her client’s goals.

Publications

Her expert opinions about the rent stabilization lease renewal process, the rights of a cooperative board and the danger of using small print on residential leases have appeared in a number of articles published in newsletters and journals.

Linda has been admitted to the New York State Bar since 1982, and has also been admitted to the U.S.D.C. for the Southern and Eastern Districts of New York.

Linda Rzesniowiecki was previously Director of Hearings at The New York City Loft Board and a staff attorney at the Housing Litigation Bureau of the Department of Housing Preservation and Development of New York City.
